The Gujarat High Court has given a green signal for redevelopment of Anand Vihar Apartments in Satellite area. The court order came after 82% members consented for the redevelopment of the 40-year-old society built by the Gujarat Housing Board (GHB). Out of 132 apartments in the society, 102 are in a dilapidated state. HC also sought action against residents who have done illegal extensions.“This Court has to exercise extraordinary powers as redevelopment is in larger public interest. It provides the benefit to the housing holders and the property right of any of the occupiers would not be affected when every occupier will get a new unit against their occupation. In the redevelopment process when almost all the members have given the consent, at the instance of few members majority members cannot be made to suffer,” the HC stated while allowing the petition filed by members in 2020.The society had passed the resolution to undertake redevelopment with consent of more than 60% members in 2018. They entered into an agreement with Siddhi Developers for redevelopment. But the project could not take off as some members objected and the matter reached HC in 2020.The court held that the requirement of consent of 75% members has been satisfied in the present case as per law. Therefore, as per the resolution the redevelopment deal between the owners and Siddhi Developers can be taken forward. The court also set aside objections raised by some flat owners that the civil suit filed in the matter should be decided first.
