AHMEDABAD: The Gujarat high court has ruled that an engineer working in a capacity of supervisor cannot be treated as a workman and his case cannot be heard by a labour court. The case involved Bharuch’s Gujarat Insecticides Ltd and its maintenance engineer S N Parwani, who was relieved in 1991 following a dispute. He approached a labour court raising an industrial dispute in 2003. The labour court ruled in favour of Parwani in 2006 and ordered the company to pay compensation to engineer in 2007. The company approached the high court questioning the labour court’s jurisdiction to deal with a case filed by an engineer, who was working in supervisory position. The engineer also filed a petition claiming back wages prior to 2003, when he raised the dispute.After hearing the case, Justice A Y Kogje said that labour court lost the sight of pay scale and nature of work of an engineer, which would not attract definition of a workman.
